Polk City Board of Adjustment

The Board of Adjustment for the City of Polk City met on February 21, 2008 at City Hall in Polk City, Iowa. Present were Angel Thomason, Dixie Bequeaith, Bill Currie, Don Raker, John Calhoun and Ken Morse. Also present was Engineering Representative Kathleen Connor. Chairman Raker called the meeting to order at 6:30 p.m.

Doug Beech, representing Casey’s General Stores, Inc., was present to request a variance to the front yard setback to allow for a larger canopy over the gas pumps. He stated Casey’s would like to install two more gas pumps to handle the volume. This will increase the size of the canopy. He stated they have already indicated on their plan to move the pumps closer together from 30’ to 25’, which is the minimum required. He stated since a gas canopy is considered the same as a structure it creates a hardship to meet all of the setbacks for both the building and the canopy. He stated it would be an advantage for the company and for the public if allowed and could also be considered a safety issue.

The variance requested is for a 14’ front setback allowance. There were no neighbors present for or against the variance request. The Chairman asked the City Clerk if any written correspondence has been received for or against the variance, she stated none had.

Board member Morse stated the petition states a request for a "small" variance, but a variance is a variance. There was discussion reference angling the corners of the canopy to reduce the size of the variance requested.

Motion was made by Raker to approve the request from Casey’s General Stores, Inc. for a 14’ variance to the front yard setback to allow for a larger canopy, second by Bequeaith. Motion was approved unanimously by roll call.

Motion was made by Raker to adjourn the meeting at 6:50 p.m., second by Bequeaith. Motion was approved vocally and unanimously.
