Regular Meeting

March 17, 2008

The Planning and Zoning Commission for the City of Polk City met in regular session on March 17, 2008 at City Hall in Polk City, Iowa. Present were Ron Hankins, Bill Kliegl, Shane Torres, and Dennis Dietz. Also present were City Administrator Gary Mahannah, City Council Liaison Ron Anderson, and Engineering Representative John Haldeman. Chairman Pro-Tem Dietz called the meeting to order at 6:00pm.

Motion was made by Kliegl to approve the minutes of February 18, 2008, second by Torres. Motion was approved vocally and unanimously.

No audience.

Chairman Pro-Tem Dietz declared it was time to close the regular meeting and open the Public Hearing on Voluntary Annexation at 6:05pm. Chairman Pro-Tem Dietz asked City Administrator Mahannah when the Public notice was published and when it was sent to the property owners. Mahannah reported that the notices had been mailed out on March 4, 2008 and published on March 6, 2008. City Administrator Mahannah explained that this is a voluntary annexation, that the city would be annexing a total of 891.03 acres of land. At this time the city has 80% of the property owners signed agreements, with the Corp of Army Engineers being neutral. He went on to explain that the land would stay zoned A-1. Upon a motion by Hankins, second by Kliegl the commission voted vocally and unanimously to close the public hearing and reopen the regular meeting at 6:10pm.

Upon a motion by Hankins, second by Torres the commission voted vocally and unanimously to recommend to council to proceed with the Voluntary Annexation.

Vince Piagentini with Associated Engineering Company of Iowa, 2917 Martin Luther King Jr. Parkway, and Mark Trost with Trost Development Services, representing Marina Development LLC was present to ask the commission to rezone the property located at 10749 NW Polk City Drive from C-2 to R-1, the reasoning for the rezoning is that the property is not able to be developed as commercial due to undulating terrain and that it lends itself better to residential development.

Upon a motion by Hankins, second by Kliegl the commission voted vocally and unanimously to recommend to council the rezoning of 10749 NW Polk City Drive from C-2 to R-1 upon the completion of City Staff recommendations.

Andrew Schreck with Civil Design Advantage along with Nick Halfhill were present to ask the commission for approval of the Amended Final Development Plan and the approval of the Final Plat for Wolf Creek Plat 6, they explained that nothing had changed since they had presented the plans before the commission at the January 21, 2008 meeting.

Upon a motion by Hankins, second by Torres the commission voted vocally and unanimously to recommend to council the approval of the Amended Final Development Plan for Wolf Creek Plat 6 upon the completion of City Staff recommendations.

Upon a motion by Hankins, second by Kliegl the commission voted vocally and unanimously to recommend to council the approval of Final Plat for Wolf Creek Townhomes Plat 6, upon the completion of City Staff recommendations.

Chairman Pro-Tem Dietz reopened the public hearing on Voluntary Annexation after the realization that an error had been made in the publication of the time of the meeting. The Public Notice had been advertised for 6:30pm instead of 6:00pm. The hearing was reopened at 6:30.

Ron Stone of 8523 Newburget Rd spoke to the commission on how orderly the annexation plans were and how the plans allowed for his land to stay zoned as Agricultural Land. He also expressed his support of the annexation.

Genive Lillskau of 10616 NW 44th Street, ask about the maintaining of the road south of 110th St. City Administrator said that nothing would change concerning the maintenance of the road.

Upon a motion by Kliegl, second by Torres the commission voted vocally and unanimously to close the public hearing reopen the regular meeting at 6:45pm

After consideration of the additional comments received during the reopened Public Hearing

the commission then reaffirmed their motion to recommend to council to proceed with the Voluntary Annexation.

No Engineers Report

Commissioner Kliegl wished to thank the city for the appreciation dinner that was held for people who volunteer with the city.

Upon a motion by Torres, second Hankins the commission voted vocally and unanimously to adjourn the meeting at 6:50pm.
